PLEASE READ THESE TERMS CAREFULLY. By creating an account, accessing, or using the AcneScore mobile application, website, or related services (collectively, the "App" or "Services"), you agree to be legally bound by these Terms of Use ("Terms"). If you do not agree, you must not use the Services.
1. ACCEPTANCE OF TERMS
By accessing or using AcneScore, you confirm that you have read, understood, and agree to be bound by these Terms and all applicable laws. If you do not agree, you may not access or use the Services.
2. ELIGIBILITY
You must be at least 13 years old to use the Services. If you are under 18 years old, you represent that you have permission from a parent or legal guardian. You agree that all information you provide is accurate and truthful.
3. INFORMATIONAL PURPOSES ONLY - NO MEDICAL, DERMATOLOGICAL, OR NUTRITIONAL ADVICE
AcneScore provides automated skin analysis, food analysis, scores, ingredient suggestions, and lifestyle insights strictly for informational and educational purposes.
THE SERVICES ARE NOT MEDICAL ADVICE AND ARE NOT A SUBSTITUTE FOR PROFESSIONAL HEALTHCARE.
AcneScore is not a licensed medical provider.
The Services are not operated by dermatologists, physicians, or dietitians.
The App is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
The App is not a regulated medical device.
No doctor-patient or professional relationship is created through use of the Services. You should consult a qualified professional before making health or dietary decisions.
HEALTH & SAFETY NOTICE
The Services are not intended for emergency situations. If you experience severe skin reactions, infections, allergic responses, or medical symptoms, seek immediate medical attention from a licensed healthcare provider.
4. AI & AUTOMATED TECHNOLOGY DISCLAIMER
AcneScore uses artificial intelligence and automated analysis to generate scores and recommendations. Outputs may be inaccurate, incomplete, delayed, or incorrect.
All acne scores, food analysis, ingredient insights, and recommendations are algorithmic estimates only and are NOT clinical evaluations.
5. FOOD SCANNER DISCLAIMER
Food-related insights are generalized estimations regarding potential acne triggers or inflammatory ingredients and are NOT professional dietary advice, medical nutrition therapy, or nutritional counseling.
6. ASSUMPTION OF RISK & ALLERGY DISCLAIMER
You acknowledge that skincare products, ingredients, and dietary changes involve inherent risks, including allergic reactions, irritation, or adverse health outcomes.
You agree that:
You are solely responsible for testing products and verifying ingredient safety.
You assume all risks associated with following recommendations or insights from the App.
AcneScore is not responsible for any reactions, injuries, or outcomes.
7. NO GUARANTEE OF RESULTS
AcneScore does not guarantee skin improvement, acne reduction, health outcomes, accuracy of scans, or effectiveness of recommendations. Individual results vary.
8. USER RESPONSIBILITIES
You agree not to:
Use the App for unlawful or harmful purposes
Upload content you do not own or have permission to use
Attempt to reverse engineer or exploit the technology
Interfere with system security or functionality
You are solely responsible for decisions made using the Services.
8A. USER CONTENT MODERATION
AcneScore reserves the right, but not the obligation, to review, remove, restrict, or disable access to any content that violates these Terms, applicable laws, or community standards.
AcneScore is not responsible for user-generated content uploaded by other users.
9. FACIAL IMAGE & CONTENT LICENSE
By uploading images, including facial images, you grant AcneScore a limited, worldwide, non-exclusive, royalty-free license to process, analyze, store, and use such content solely for providing and improving the Services.
You represent that you have the legal right to upload any images you provide.
9A. BIOMETRIC & FACIAL DATA DISCLOSURE
By uploading facial images or using scanning features, you acknowledge that certain images or scan-derived data may be considered biometric identifiers or biometric information under applicable laws.
AcneScore processes facial images solely to generate automated skin analysis, acne scores, and related features within the Services. AcneScore does not sell biometric data.
Facial images are processed using automated technology and may be stored temporarily to provide Services.
Users may request deletion of their data by contacting support@acnescore.app.
AcneScore retains data only for as long as reasonably necessary to operate and improve the Services, unless longer retention is required by law.
By using the scanning features, you provide informed consent for this processing.
10. THIRD-PARTY SERVICES & PRODUCTS
The App may reference or recommend third-party products, APIs, or services. AcneScore does not manufacture, sell, or guarantee any third-party offerings and disclaims responsibility for their safety, claims, or performance.
10A. SUBSCRIPTIONS, BILLING & AUTO-RENEWAL
Certain features of the Services may require a paid subscription. By purchasing a subscription, you authorize recurring billing through your Apple App Store or Google Play account.
Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period.
Pricing, billing frequency, and features may change with reasonable notice where permitted by law.
Payments and refunds are handled by the platform provider (Apple or Google), and AcneScore does not directly process payment information.
You are responsible for managing your subscription through your device's account settings.
11. BETA FEATURES & TECHNOLOGY LIMITATIONS
Some features may be experimental, evolving, or subject to errors, outages, or unexpected results. AcneScore makes no guarantee of uninterrupted or error-free operation.
12. INTELLECTUAL PROPERTY
All content, branding, software, algorithms, designs, and technology within AcneScore are owned by AcneScore and protected under intellectual property laws. Unauthorized copying, resale, or distribution is prohibited.
13. DISCLAIMER OF WARRANTIES ("AS IS")
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, RELIABILITY, OR NON-INFRINGEMENT.
14. LIMITATION OF LIABILITY
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ACNESCORE AND ITS OWNERS, AFFILIATES, EMPLOYEES, CONTRACTORS, AND PARTNERS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO HEALTH ISSUES, ALLERGIC REACTIONS, LOST PROFITS, DATA LOSS, OR FINANCIAL DAMAGES.
IN NO EVENT SHALL ACNESCORE'S TOTAL LIABILITY EXCEED THE GREATER OF:
(A) THE AMOUNT YOU PAID TO ACNESCORE IN THE LAST TWELVE (12) MONTHS; OR
(B) ONE HUNDRED U.S. DOLLARS ($100).
15. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless AcneScore from any claims, damages, liabilities, losses, or expenses arising from:
Your use or misuse of the Services
Your reliance on App outputs
Your violation of these Terms
16. ARBITRATION AGREEMENT & CLASS ACTION WAIVER
Any dispute arising out of or relating to these Terms or the Services shall be resolved exclusively through binding arbitration, and not in court, except where prohibited by law.
You agree to waive any right to participate in class actions or class-wide arbitration against AcneScore.
17. FORCE MAJEURE
AcneScore shall not be liable for any delay or failure resulting from causes beyond reasonable control, including system outages, third-party API failures, internet disruptions, natural disasters, or governmental actions.
18. ACCOUNT TERMINATION
AcneScore reserves the right to suspend or terminate access at any time for violations of these Terms, unlawful activity, or misuse of the Services.
19. MODIFICATIONS TO SERVICES OR TERMS
We may modify these Terms or the Services at any time. Continued use after updates constitutes acceptance of the revised Terms.
20. PRIVACY
Your use of the Services is also governed by the AcneScore Privacy Policy. By using the App, you consent to the collection and processing of data necessary for operation and improvement.
DATA IMPROVEMENT & ANALYTICS
You acknowledge that AcneScore may use anonymized, aggregated, or de-identified data to improve algorithms, enhance features, develop analytics, and optimize performance of the Services.
21. ENTIRE AGREEMENT
These Terms constitute the entire agreement between you and AcneScore regarding the Services and supersede any prior agreements or understandings.
22. BIOMETRIC DATA & FACIAL INFORMATION
AcneScore may collect and process facial images for the purpose of generating automated skin analysis, acne scores, and related insights.
Facial images may be considered biometric identifiers under applicable laws.
Data is processed solely to provide and improve the Services.
AcneScore does not sell, lease, or trade biometric data.
Facial images are retained for no longer than 24 hours after processing, unless the user explicitly chooses to save them.
Users may request deletion of their data at any time by contacting support@acnescore.app.
By using the facial analysis features, you provide informed written consent to this processing.
Reliance Disclaimer
You agree that outputs, scores, and recommendations provided by AcneScore should not be relied upon as the sole basis for health, skincare, or dietary decisions.
22. GOVERNING LAW
These Terms shall be governed by the laws of the State of California, without regard to conflict-of-law principles.

24. SEVERABILITY
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.
